The South African FICA (Financial Intelligence Centre Act 11/2008) – An Example of Flagrant Abuse of the Legislative Process

Through the promulgation of a myriad of ridiculous time and production constraining and stifling laws and regulations the [ANC] government and state write arbitrary standards that favour themselves through very devious and clandestine motives of a despot in order to reign supreme by which they force themselves on the citizens towards whom they have no rights, but only obligations. Especially so when aforementioned get promulgated by a government and state institutions loaded by morally culpable politicians and bureaucrats who dispense favours and contracts with public funds. As Tacitus declared in the 2nd century AD: “The more corrupt the state, the more numerous the laws….” And corruption undermines rule of law, prevents or subverts institutions from functioning honestly, and encourages cultures of lawlessness. When “institutionalized corruption” becomes the norm, and consolidates its political power, when there is “state capture,” we find ourselves facing kleptocracies, ruled by thieves.

“FICA is a monumental failure and should be scrapped”
Leon Louw

The FICA is but one notorious example of the worst discriminating political and financial sector power mongering, misuse of legislative authority, undue interference and manipulation in business, production and private affairs processes. The aforementioned were conceived in ignorance and greed, and born out of injustice. Constitutionally they are mostly unenforceable.

The FICA, tax, security, and many other laws are perfect resemblances of spider webs through which the big flies pass and the little ones get caught. Those are bad laws and as such constitute the worst sort of tyranny. They (and many other legislation) deviate fundamentally from right reason and Eternal Law. They are in fact no ‘law’ at all, but rather an assertion of violence. The so-called ‘empowered’ organizations, banks, financial institutions and individuals in terms of the FICA and other legislation have no constitutional rights or justified power as prosecutors and/or enforcers of law over their clients’ and the citizens’ interests.

The FICA points towards suspected ‘money laundering’ and ‘funding of terrorist activities’ (all relative virtual concepts and machinations based on flawed subjective suspicions lacking true definition and basis for enforcement) by anybody in possession of money. In other words, presumptions of concepts created by laws without fundamentals, thereby flawed implications of which were created by the same set of laws.

The FICA, like capital controls, are means to trap your money and possessions making it easier to steal. To draft, approve and execute such legislation one must be either a fraud or a fool.

By means of the above-mentioned the government and state engage in, inter alia:

  • economic terrorism;
  • legalized criminality (via taxes, land-grabs, confiscations, disarming citizens without providing their protection, expiry dates to licenses & qualifications, etc.);
  • sabotage of personal liberties and freedom without due qualification between harmful and non-harmful conduct;
  • deliberate destruction of personal development and progress;
  • undue usurpation of values for narrow greedy and personal enrichment ends of those in office.
